Novate Solutions®, Inc. (“Novate”) is committed to protecting the privacy of those who entrust us with their personal information.  Our customers and employees trust and expect that we will protect their personal information in accordance with the promises we make. “Personal information” means any information pertaining to an identified or identifiable individual and may include, for example, email addresses and contact details and any similar information provided to us in the course of our business operations. Personal information that is de-identified or made anonymous is not considered personal information. This Privacy Policy details our commitment to your privacy.  We do not collect or share your data for marketing, advertising, or other commercial purposes.  By using this Website, you are agreeing to accept the terms of this Privacy Policy, including the limitation of liability, below. 


This Privacy Policy describes Novate’s privacy practices regarding personal information it receives in connection with the services and products Novate provides to its Customer (the “Services”), as well as through our website. This policy describes the information that Novate collects about visitors to our websites, web applications, or mobile applications, if applicable (collectively, the “Website”) or about our customers, prospective customers, employees and prospective employees, how we use that information and how we protect that information.   


Novate does not collect personal information unless you provide it to us, but does collect your Internet Protocol address, but this information generally does not reveal your identity. We do not use “cookies,” small files that are sent to your browser and stored on your hard drive, to identify you as a unique user on our Website.

Offline, we collect information that you provide us to set up an account or otherwise form a customer relationship with Novate or to consider you for a job with Novate. Once an account is opened or customer relationship is formed, we may collect information about your purchasing and payment history. If you are hired by Novate, we reserve the right to conduct background checks and investigate all information that we are permitted to obtain under California law. 


Online, Novate only collects personal information through its section labeled “Job Opportunities.”  For those purposes, Novate may perform validation of identity of applicants to meet legal obligations.

Information You Provide

When you visit our Website, you may provide personally identifiable information in order to take advantage of job opportunities offered through our Website. For example, you might provide your name, address, telephone and fax numbers, and email address in the employment section. We collect and store that information. If you choose to provide us with personally identifiable information, we will use that information to respond to your application.

You may always choose not to provide the information we requested in the employment application, or by not providing a resume. Providing Novate with personal information under “Job Opportunities” or by transmitting a resume or CV to Novate under this section, constitutes consent for Novate to store and use this personal information for purposes of employment and investigated the potential employee’s suitability for employment, for a reasonable period of time, not to exceed any limitations as provided by California law.    

Offline:  When you sign up for an account or otherwise do business with Novate, you may provide personally identifiable information of yourself, if an individual or sole proprietor, or Novate officers or contact persons, in addition to Novate information, if a Novate. We may use that information to obtain a credit, D&B or similar report or otherwise evaluate your eligibility for an account or line of credit. When you apply for a job or a line of credit, you may provide personally identifiable information, such as name, address, telephone number, email address, date of birth, and SSN. We may use that information to obtain a credit report, do a background or reference check or otherwise evaluate your suitability for the job.

Third Party Disclosure Reservation:  Novate reserves the right to disclose ANY personally identifiable information to third parties, if Novate believes in good faith we are required to do so (a) by law or to comply with the law or legal process; (b) to protect and defend our rights or property or the rights or property of our clients; or (c) in an emergency to protect the personal safety of our employees, clients, visitors or the public. Novate may also disclose information to its accountants, auditors, agents, lawyers and other advisors in connection with the enforcement or protection of our legal rights or to protect the interests or safety of our customer, our customers’ customers, employees or others, in accordance with or as authorized by law.

Information from our Clients and Their Customers

Novate may process transactions or applications that are supplied and managed by our customers transmitted via email. As a result, although we may access certain personal information of our customers’ customers pursuant to the contractual relationships with have with our customers, we typically do not collect and store personal information in our own systems except as may be necessary to provide services to our customers. Typically, our customers are responsible for complying with all notices, notifications and alerts to individuals whose information is entered into our systems or portals. We do not use or share that personal information that we do store, except as directed by our customers or as required by law.

No Sale of Personally Identifiable Information. Novate does not collect and does not sell any personally identifiable information on its Website except or those individuals seeking employment under the section “Job Opportunities.”  That information will be kept strictly confidential and will not be sold or disclosed to third parties.


Novate currently does not use personal information from its customers to contact them about our Website and Services.


Novate may access your geolocation. To stop the collection of precise location information in connection with your use of our mobile applications, use your device’s settings to deactivate our mobile applications’ access to the device’s location services.


Novate uses encryption software in our Website to safeguard certain of your personally identifiable information under Job Opportunities.  While that information is transmitted over the Internet, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer. Where applicable, Novate uses industry standard technology in connection with our Services and on the Website to help protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction.


Personal information provided to Novate for purposes of employment, shall be retained until the position is filled, or as otherwise permitted by California law.  If you wish to have your information removed or destroyed, you may send a request to legal@novate.com, or contact Novate at 866-668-2830.


If Novate learns that a child under the age of 18 has submitted personal information online without parental consent, it will take all reasonable measures to delete such information from its databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personal information Novate has collected from children under age 18, please contact us by sending an electronic request to legal@novate.com, or contact Novate at 866-668-2830.


Any claim, dispute or controversy (whether in contract, tort or otherwise, whether statutory, common law or equitable and whether pre-existing, present or future) against Novate, its agents, employees, affiliates, successors and assigns, relating to this Privacy Policy will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Any arbitration will be conducted before a single neutral arbitrator and will be limited solely to the dispute between you and Novate. The arbitration will be conducted in Sacramento, California, or the greater Sacramento area, or online, as determined by the arbitrator. Any award of the arbitrator will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.  If any claim, dispute or controversy is not subject to binding arbitration, you agree that the exclusive jurisdiction for that claim, dispute or controversy will be the state of California,, that you will not file any action or proceeding in any other jurisdiction; and that you waive any argument that Sacramento, California, is an inconvenient forum.

Novate’s policy does not extend to anything that is beyond Novate’s reasonable control, including but not limited to potential insecurities inherent in the operation of the Internet.  Novate uses reasonable precautions to keep your personally identifiable information secure, whether it was collected online or offline. However, Novate is not responsible for any breach of security or for the actions of any third parties. Nothing herein is intended to modify, alter, or otherwise supercede any express agreements regarding confidentiality or confidential information between Novate and any of its customers, its customers’ customers, employees, or third parties.
